Web Hosting Agreement

This Web Hosting Agreement ("Agreement") is entered into by and between Trendwise SEO Consulting ("Service Provider") and the undersigned client ("Client"). By engaging Trendwise SEO Consulting's web hosting services, the Client agrees to the following terms and conditions:

1. Services Provided

  • 1.1 The Service Provider agrees to provide web hosting services to the Client for a fee of $20 per month.
  • 1.2 Web hosting plans provided by the Service Provider do not include any SEO services. Hosting services are limited to regular website backups and ensuring the website remains live.
  • 1.3 If the Client opts for domain registration and hosting through the Service Provider, additional terms may apply as outlined in Section 3.
  • 1.4 To ensure proper DNS configuration, the Client must add the Service Provider as a delegated user in their domain registrar account. This access is necessary to set up DNS records correctly.
  • 1.5 The Client will always have access to the website and will be provided with a username and password. If the website is compromised due to the Client’s credentials being compromised, the Service Provider will restore or fix the website at an additional cost.

2. Payment Terms

  • 2.1 The monthly web hosting fee of $20 is non-refundable.
  • 2.2 Payment must be made on a recurring monthly basis as agreed upon at the initiation of services.
  • 2.3 If the Service Provider has registered the domain on behalf of the Client, the Client must pay in full any outstanding balances before the EPP code is released to transfer the domain to another registrar.
  • 2.4 If the Client’s domain is registered with a third-party registrar, the Client retains ownership of their domain, and no EPP code is required from the Service Provider.

3. Cancellation Policy

  • 3.1 If the Client’s website and domain are hosted and/or registered by the Service Provider, a 30-day written notice is required to cancel services.
  • 3.2 If the Client’s website is hosted by the Service Provider but the domain is registered with a third-party registrar, a 30-day written notice is also required to cancel services. During this period, the Service Provider will:
    • Assist with backups of the current website.
    • Provide any necessary support to facilitate a smooth transition.
  • 3.3 The cancellation notice must be sent via email or written communication to the Service Provider's designated contact address.
  • 3.4 The refund and cancellation policy for web design and development services provided by Trendwise SEO Consulting, as outlined on the official website at https://trendwiseco.com/refund-and-cancellation-policy-web-design-and-web-development/, is incorporated into this Agreement by reference. Clients are encouraged to review this policy.

4. Termination and Offboarding

  • 4.1 Upon receipt of a cancellation notice, the Service Provider will initiate the offboarding process.
  • 4.2 The Client is responsible for ensuring that all website data is backed up prior to the end of the 30-day cancellation period. The Service Provider will assist with this process but assumes no liability for data loss after the cancellation period has ended.
  • 4.3 The Service Provider will terminate hosting services at the end of the 30-day notice period.

5. General Terms

  • 5.1 The Service Provider reserves the right to update or amend this Agreement with 30 days' written notice to the Client.
  • 5.2 This Agreement constitutes the entire agreement between the parties and supersedes any prior written or oral agreements.
  • 5.3 The Client agrees to comply with all applicable laws and regulations while using the Service Provider's hosting services.

6. Limitation of Liability

  • 6.1 The Service Provider will not be held liable for any indirect, incidental, or consequential damages arising from the use of its web hosting services.
  • 6.2 The Service Provider’s total liability under this Agreement shall not exceed the amount paid by the Client for services during the 12 months preceding any claim.
  • 6.3 If the website is compromised due to the Client’s credentials being compromised, the Service Provider will restore or fix the website at an additional cost to the Client.

7. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction where the Service Provider is headquartered.
